- Payment of Charges
Subscriber agrees to pay, using a valid credit card which LeadToRealty accepts, the charges incurred on Subscriber's account in order to access Fee-Based Services, applicable taxes, lead payment fees, and any other applicable fee. LeadToRealty reserves the right to increase fees, surcharges, and site subscription fees, or to institute new fees at any time, upon reasonable notice posted in advance on this Site. LeadToRealty will automatically charge Subscriber's account for any lead made available to the Subscriber. In the event LeadToRealty cannot charge Subscriber's account, LeadToRealty reserves the right to terminate Subscriber's access to the Fee-Based Services.
For purposes of identification and billing, Subscriber agrees to provide LeadToRealty with accurate, complete, and updated information required by the site subscription registration to the Fee-Based Services ("Registration Data"), including Subscriber's name, address, telephone number(s), and applicable payment data (e.g., credit card number, e-mail address, and expiration date). Subscriber may check, by accessing their self service account portal, to determine whether Subscriber's Registration Data is current and accurate, and, if not, to correct or update Subscriber's Registration Data. Failure to comply with this provision (including, without limitation, falsification of any Registration Data) may, at LeadToRealty’s option, result in immediate suspension or termination of Subscriber's right to use the Fee-Based Services.

- Credit resolution
In the event that a lead credit request for a purchased lead is resolved in favor of a paying user leadtorealty will issue a service credit to the user account for one lead of the same type that was purchased. User account credits cannot be credited. User account credits cannot be refunded.
In the event that you cancel the service, leadtorealty will not refund any fees already paid by the subscriber. Refer to the "participation guidelines" for information on the credit request and resolution process.
All sales are final for leads purchased through the LeadToRealty Express program; no refunds or exchanges will be issued.

- Cancellation and Termination
1. The subscriber is solely responsible for properly cancelling his/her account. To request the cancellation of the account the subscriber needs to properly address an email to customerservice@leadtorealty.com. All email requests for cancelling the account must include the word "cancel" as part of the subject field and must clearly request the termination of the account. We will acknowledge your cancellation request by email or by telephone within five business days. If you don't receive an acknowledgement within this period day please call our customer service department to determine if your request was received.
2. As part of the cancellation process we may require you to complete and fax a signed copy of our cancellation form. You are responsible for returning the completed form so the account can be properly cancelled.
3. Cancellation requests are only processed during regular business hours during business days. We reserve the right to take up to 3 business days to cancel your account. Business days are Monday through Friday, 8 AM EST to 4 PM EST; excluding holidays.
4. You are responsible for the payment of any charges incurred by your account from the time that the cancellation request was made until the account is terminated.
5. In the event of termination, your account will be disabled and you may not be granted access to your account or any files or other content contained in your account although residual copies of information may remain in our system.

LeadToRealty, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other LeadToRealty service, for any reason at any time. Such termination of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all information in your Account. LeadToRealty reserves the right to refuse service to anyone for any reason at any time.

- Indemnification
You agree to hold harmless and indemnify Agitantis LLC, and its subsidiaries, affiliates, officers, agents, and employees from and against any third party claim arising from or in any way related to your use of the Service, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature. In such a case, Agitantis LLC will provide you with written notice of such claim, suit or action.

If you knowingly input false information in a referal request, including but not limited to some one else's name, e-mail address, physical address or phone number or a random or made up name, address, e-mail or phone number you agree to fully indemnify and be liable to leadtorealty and each leadtorealty registered real estate agent who accepts such referal requests, for the greater of: (1) a minimum amount of $15,000 to each of leadtorealty and each of the affected real estate agents and for each of the actual person(s) affected by any of the improper, incorrect or fraudulent information you enter (for example the actual owner of the e-mail address or phone number, etc.), per improper submission, plus any attorneys fees costs and expense relating thereto, if applicable, or (2) the actual damages, direct, punitive and consequential, and any regulatory or judicial fines or penalties that may arise from such intentional, misleading, harmful and fraudulent activity, plus reasonable legal fees, cost and expenses relating thereto, which ever is greater.
