General Information
- What We Do
We act as a venue for individuals buying and selling homes to make introductory communications with licensed Real Estate Agents. We charge a nominal fee per introduction to local Real Estate Agents for use of this communication venue. Our services are provided free of charge to individual home sellers and buyers.

- What We Don’t Do
We act neither as a real estate broker nor a real estate salesman as defined by the division of Business and Professional Code specific to Real Estate Law.
We do not broker transactions. We are not responsible for selling, purchasing, exchanging, renting or leasing property. We seek no commission for real estate transactions, have no involvement in the transaction process and have minimal knowledge (e.g., customers submitting testimonials), if any, of whether a transaction took place.
We make no representations or warranties about sellers (e.g., including property characterizations), buyers (e.g., including financial capabilities), or participating Real Estate Agents.

- Equal Housing Opportunity
LeadToRealty will be your most Cost Effective marketing tool. Customers you find through LeadToRealty cost a fraction of those obtained via direct mail, yellow page ads, newspaper ads, and expensive back-end referral services.

- Responsibilities of Buyers & Sellers
In using our services you, as a home buyer and/or seller, warrant, represent and agree that:
• You will provide LeadToRealty with valid contact information.
• You are interested in being contacted by a Real Estate Agent about buying and/or selling services and the information you provide. LeadToRealty related to interest in these services is correct.
• You are of legal age and are otherwise capable of forming a legally binding contract.

- Certification of Agents
In using our services, each Real Estate Agent certifies that:
• They are a Real Estate Agent with a current and valid license.
• They have worked or lived in the area where they currently work as a Real Estate Agent for at least 1 year.
Limits of Service
- Referral Service
We do not guarantee that we will be able to match your Real Estate needs with a Real Estate Agent or that there are Real Estate Agents in your area that either are capable or willing to complete your Real Estate needs.
It is entirely up to the Buyer/Seller to enter into a direct contract or otherwise reach agreement with a Real Estate Agent. LeadToRealty does not guarantee or warrant the services provided by Real Estate Agents that LeadToRealty refers to you. Each buyer/seller must independently verify the quality and experience of each Real Estate Agent that they hire.

- Qualification of Referral Information
We screen the referral information we provide to Real Estate Agents. In case of credit requests for leads the Real Estate Agent must contact us within 72 hours from the time that the lead was sent in order for our staff to review the request. After the credit request is reviewed our staff will notify the Real Estate Agent of the decision. We reserve the right to deny any credit request and our staff's decision is considered final.

Billing
- Payment of Charges
LeadToRealty may terminate or disable User account if User fails to pay any amount due to LeadToRealty when due. If the credit card expires or otherwise declines payment access to LeadToRealty can be modified or suspended. If payment is more than thirty (30) calendar days past due an additional 15% of the balance, or the maximum allowable by law, whichever is less, may be assessed on the total amount of the late payment, and the entire amount unpaid Charges or other outstanding balance (if any), plus this assessment, will become immediately due and payable. The User shall pay all costs of collection, including legal fees, incurred by LeadToRealty.

- Draw-Down Balance
All services included in the subscription plans are charged against a draw-down balance that the customer establishes with LeadToRealty. The system will automatically manage your charges for you, based on thresholds set according to your account profile. The draw-down account mechanism is used to avoid account suspensions due to credit card processing failures.

- Recharge Threshold
The Recharge Threshold is the amount of available funds in your account that triggers an account recharge. It is set to 10% over the amount necessary to pay for all types of leads that an account is set to receive.

- Credit Card Disputes/Chargebacks
LeadToRealty has a zero tolerance policy for chargebacks. Any customer who disputes a credit card payment is subject to suspension and account termination at LeadToRealty's discretion.

- Modification of Service
LeadToRealty reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that LeadToRealty shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
